General conditions of the loyalty card
The TAMASHOP loyalty program.

How to earn points?
1 point for each euro spent (point valid for 1 year).
25 points for creating an account (limited to one account per natural person).
25 points for subscribing to the Tamashop SMS mailing list.
25 points for subscribing to the Instagram account @Tamashop___ (limited to one account per natural person).
50 points following the publication of looks worn exclusively with Tamashop products, the photo must show the item worn and full length with a share in public story exclusively., mentioning on the publication the Tamashop account (@Tamashop___) and sending in private message the order number linked to the items presented.
PLEASE NOTE, limited to 1 publication on Instagram per fortnight (15 days) and per order.
Referral Program:
Offer valid online only.
To benefit from the sponsorship program, as a sponsor, you must have spent at least €40 over the last 365 days to share it with your sponsor. The sponsor must in turn spend at least €40 on the website to benefit from the offer.
TAMASHOP loyalty program:
To protect against fraud, if a customer enters a birthday that falls within the next 30 days, their reward will be delayed 30 days from the date of entry.
TAMASHOP loyalty program:
The loyalty program (“Loyalty Program”) is offered by the limited liability company TAMASHOP, registered with the RCS of Quimper 95247379100012, whose head office is at 3 place Carnot 29300 Quimperlé.
The Loyalty Program is set up for the benefit of customers of Tamashop Establishments.
The Client is individually or collectively referred to as the “Party(ies).
The Loyalty Program is governed by these T&Cs.
Tamashop is responsible for retaining the Establishments’ Customers.
The program allows Customers to accumulate points and benefit from the rewards described on this page, following their purchases in the Establishments.
This Loyalty Program is exclusive of any other loyalty program, and therefore cannot be combined with the use of another loyalty program for any stay within an Establishment.
The Establishments
The list of Tamashop brand establishments participating in the Loyalty Program (the “Establishments”) is regularly updated by Tamashop, without this constituting a modification of the T&Cs.
Tamashop may inform the Customer regularly by email, if the Customer has provided a valid email address. The Customer may choose to subscribe or unsubscribe to this notification, within his Personal Account.

Tamashop is free to update this list, including by removing or adding Establishments. No guarantee is provided to the Customer as to the maintenance of an Establishment in the list of participating hotels, which the Customer accepts.
CG and Loyalty Program
Membership conditions
The Loyalty Program is free and open to all individuals aged over eighteen (18).
They must also have full legal capacity to enter into a contract.
Legal entities cannot register for the Loyalty Program.
If a Customer who does not comply with these conditions registers for the Loyalty Program, TAMASHOP will be free to terminate the registration of this Customer, for non-compliance with the T&Cs, in accordance with the Article “End of the Loyalty Program”.
A Client may join the Program:
By registering online on the website www.tama-shop.fr and that of the Establishments.
Via the means made available to the Client within the Establishments.
The Client must read the T&Cs and accept them when registering:
Membership in the Loyalty Program is for an indefinite period.
When registering, the Client must provide the following information, which must be factual and up to date:
- Name
- First name
– Mobile phone
– Full address
- Date of birth
The Customer must keep their information up to date for the entire duration of their registration in the Loyalty Program. Any error by the Customer in this regard, or failure to update the information, as well as their consequences, will be the responsibility of the Customer.
Modification of the CG
Tamashop is free to modify the Loyalty Program T&Cs at any time, in any way whatsoever.
The Customer will be notified by email, to the address provided by the Customer. The Customer accepts the modified T&Cs upon their next connection to their Personal Account.
Tamashop is notably free to modify the Establishments, the methods of calculating points, and the rewards offered.
The list of Establishments may be modified without any notification to the Client, which the Client accepts.
Personal account
Tamashop creates as soon as possible after the Customer's registration, a personal account for the Customer (the "Personal Account"), accessible on the site https://tama-shop.fr/account
The Customer will be responsible for choosing the username and password for his/her Personal Account, and ensuring that they are sufficiently secure, in accordance with good security practices.
The Customer must ensure that the identifier and password of his Personal Account are kept confidential.
Tamashop will not be liable in the event of unauthorized access by a third party to the Personal Account, in the event of a brute force attack due to an insufficiently secure identifier or password. No compensation may be requested by the Customer in this regard.
Map
Upon membership, the Client receives a dematerialized card (the “Card”) available on his/her personal Account.
This Card has no time limit.
The Card is nominative and strictly personal. The Card can only be used by the Customer whose name appears on the Card. It cannot be sold, loaned or transferred.
Each Customer can only hold one Card.
The Customer will be responsible for printing the Card in a readable paper format or being able to present it on any readable display medium (phone or tablet). If the Customer cannot present his Card in a readable format when checking out of the Establishment, the points cannot be accumulated on his Personal Account.
It does not constitute a means of payment and does not guarantee the reservation.
In the event of loss or theft of the Card, or loss of the Personal Account identifiers, the Customer will be responsible for informing Tamashop, which may, at its discretion, offer the Customer to issue a new Card attached to the Customer's Personal Account or reset the Personal Account identifiers. The Customer's points will not be lost.
Tamashop will not be held liable in the event of loss or theft of the Card, and the consequences suffered by the Customer such as fraudulent use of points by a third party.
Benefit from the points
To collect Loyalty Program points, the Customer must present his Card when checking out of the Establishment.
Failing this, the points will not be credited to the Customer's Personal Account and will be irretrievably lost. No claims will be accepted in this regard, which the Customer accepts.
If the Customer has presented his Card when checking out of the Establishment, and if the points have not been credited to the Customer's personal Account following this presentation and within the time period provided for in the T&Cs, the Customer may contact Tamashop customer service for this purpose, as indicated in the "Contact" Article of the T&Cs.
Misuse
Misuse or fraudulent use of accumulated points, false registration information, or inappropriate behavior towards the Establishment staff or the Loyalty Program manager may result in the implementation of the “End of the Loyalty Program” Article by Tamashop.
Accumulation of points
The Customer may request to accumulate points on his Personal Account when he makes a paid purchase in one of the Establishments or website www.tama-shop.fr.
The purchase must be, cumulatively:
– Eligible for the Loyalty Program,
– Purchased on behalf of the Customer,
– Carried out by the Client, in person.
Points accumulated in a Customer's Personal Account cannot be transferred to another Customer's Personal Account.
Accumulated points cannot be used as a means of payment and therefore have no monetary value. They cannot be converted into money, or returned in the form of money.
Calculation of points
Points are accumulated as follows:
– €1 incl. VAT eligible spent = 1 point
These terms of calculating points may be modified at any time by Tamashop, without the Customer being able to object.
If you spend an amount in euros including cents, the amount will be rounded down. No upward rounding will be done.
In the event of cancellation or refund (in whole or in part) of an eligible purchase, no points will be accrued for the Customer's cancelled or refunded expense.
The points appear on the Customer's Personal Account no later than seven (7) days from the date of presentation of the Card to the Establishment by the Customer.
The Customer can check his points balance on his Personal Account.
Tamashop is free to reset the points balance to zero at the end of each calendar year, in addition the points are valid for 1 year.
In this case, once the calendar year has ended, or the validity period of 1 year has passed, the points accumulated during this calendar year will be definitively lost if they are not used by the Customer to obtain a reward, before the end of the calendar year, without TAMASHOP incurring any liability or having to compensate the Customer, in any way whatsoever.

End of the Loyalty Program
In the event of non-compliance with one of the obligations of the T&Cs by the Client, TAMASHOP will be free, immediately and unilaterally, without notice, without compensation and without incurring liability, to:
– Suspend the Customer’s registration in the Loyalty Program,
– Terminate the Customer’s registration in the Loyalty Program,
– Delete the points accumulated by the Customer within the framework of the Loyalty Program,
– Blacklist the Customer, to prohibit any future re-registration of the Customer in the Loyalty Program.
In the absence of use of the Loyalty Program by the Customer for a period of one (1) year, TAMASHOP may unilaterally terminate the Customer's membership in the Loyalty Program, without notice, without compensation and without incurring liability.
The Customer will also be free to unsubscribe from the Loyalty Program at any time, via the tool provided for this purpose within their Personal Account, or by contacting TAMASHOP at the address given in the T&Cs.
TAMASHOP will also be free to terminate the Loyalty Program, at any time, unilaterally, and without compensation, without incurring any liability. In this case, three (3) months' notice will be given to the Customer by email, who must then use their points before the end of the notice period. Failing this, they will be irretrievably lost on the end date of the Loyalty Program.
In the event of termination of the Customer's registration in the Loyalty Program, or termination of the Loyalty Program, for any reason whatsoever, all points accumulated by the Customer will be irretrievably lost, as of the end date of registration. The Customer will not be able to recover points not used prior to this date, in any way whatsoever, nor request any compensation.

TAMASHOP will respond to any request as soon as possible.
Responsibility
TAMASHOP's obligations under this Agreement are undertaken only as an obligation of means.
TAMASHOP will not be liable for any direct or indirect damages related to a malfunction of any element of the Loyalty Program or the Card, for any reason whatsoever.
This limitation of liability concerns any type of indirect damage, including, but not limited to, operating losses, loss of turnover, loss of orders, loss of earnings, loss of data or other information, loss of customers, loss of anticipated savings, damage to image and reputation, loss of opportunity.
TAMASHOP will make its best efforts to ensure that the accumulated points are credited to the Personal Account as soon as possible, and that the rewards reach the Customer as soon as possible.
In the event of non-compliance with its obligations under the T&Cs by the Customer, or in the event of behavior that harms the interests of TAMASHOP, TAMASHOP will be free to hold the Customer liable and implement the Article “End of the Loyalty Program”.
Personal data
Within the framework of these General Terms and Conditions and the Loyalty Program, personal data relating to the Customer may be collected by TAMASHOP and subject to automatic processing.
TAMASHOP undertakes to respect its obligations under the applicable legislation regarding personal data.

Disputes and applicable law
The T&Cs are subject to French law, regardless of the Client's place of residence.
The T&Cs are written in French, and the French version will prevail even if translated into another language.
Any dispute relating to the execution or interpretation of these General Terms and Conditions, not resolved amicably between the Parties, will be submitted to the competent court of the headquarters of TAMASHOP, including in the matter of summary proceedings, a call for guarantee or a plurality of defendants, and regardless of the country of origin of the Client.
General
Entire Agreement
These T&Cs prevail over any other stipulation potentially applicable to their subject matter. These T&Cs cancel and replace any prior commitment of the Parties relating to the subject matter and constitute the entire agreement between the Parties with respect to the subject matter hereof.
Exclusivity
No exclusivity is concluded between the Parties by the acceptance of these General Terms and Conditions. The Parties remain free to contract with third parties of their choice.
Survival of certain stipulations
The termination of these General Terms and Conditions, for whatever reason, shall not constitute an end to clauses whose nature or content requires their maintenance.
Partial invalidity
If one or more provisions of these T&Cs are held to be invalid or declared as such pursuant to a law, regulation or following a final decision of a competent court, they shall be deemed unwritten. The other provisions shall retain their full force and scope.
Non-waiver and tolerance
The fact that TAMASHOP does not assert against the Client a breach of any of the obligations referred to in these General Terms and Conditions cannot be interpreted for the future as a waiver of the obligation in question and does not have the effect of granting the other Party acquired rights.
Any failure or delay in exercising a right by TAMASHOP shall not be construed as a waiver of that right.
Independence
Neither Party may make any commitment in the name and/or on behalf of the other. Furthermore, each Party remains solely responsible for its acts, allegations, commitments, services, products and personnel.
Evidence
The Parties agree that all electronic communications, including email, constitute proof between them.
The Customer recognizes in particular the evidentiary value of TAMMASHOP's automatic recording systems and, unless he provides proof to the contrary, he waives the right to contest them in the event of a dispute.
Force Majeure
In the context of the execution of these General Terms and Conditions, TAMASHOP will not be held liable in the event of failure to perform its obligations due to any force majeure event.
For the purposes of these T&Cs, force majeure is understood as any unforeseeable, irresistible event beyond the Parties' control within the meaning of French law and case law.
In the event of the occurrence of a case of force majeure, this will have the effect of suspending the execution of TAMASHOP's obligations, which will do its best to limit the consequences and resume execution of the T&Cs as soon as the event or circumstances of force majeure disappear or cease.
